Amazon has successfully appealed a substantial 746-million-euro fine levied by Luxembourg's data protection authority. The court's decision, made on March 13, 2026, found that the National Commission for Data Protection (CNPD) did not conduct a thorough analysis before issuing the penalty in 2021.
Specifically, judges determined that the CNPD failed to assess whether Amazon intentionally breached General Data Protection Regulation (GDPR) rules or was merely negligent. The court also noted that the regulator did not explore alternative sanctions, issuing the fine almost automatically.
This ruling annuls the 2021 decision, requiring the CNPD to reassess the case with a proper analysis. Amazon welcomed the judgment, stating they disagreed with the disproportionate initial fine.
