Payne has decided to appeal the suspension, which could prevent him from traveling with the team to Madrid, Spain for their Week 11 matchup against the Dolphins.
The NFL has had a varied track record on player suspensions this season. While some, like Lions safety Brian Branch and Broncos linebacker Dre Greenlaw, have had their one-game bans upheld, others like Commanders linebacker Frankie Luvu have seen their punishments reduced to a fine. The league previously suspended Eagles defensive tackle Jalen Carter for one game with pay for spitting on Cowboys quarterback Dak Prescott.
Payne's suspension, if upheld, would cost him $1.087 million in lost salary.
