A 92-year-old Texas man's death is the subject of a wrongful death lawsuit after a pharmacy allegedly dispensed the wrong medication for 66 days. Joseph Hamilton Broussard's daughter filed the complaint against Houston's Mercury Drive Pharmacy.
An expert medical opinion submitted to the court indicates Broussard's 11-month decline and eventual death on June 7, 2025, were a direct result of being given the incorrect drug. This medication, pioglitazone, a diabetes drug, exacerbated his pre-existing congestive heart failure.
The lawsuit alleges negligence and breaches in the standard of care, asserting that fundamental checks, such as verifying the patient's name on the prescription bottle, were not followed. Broussard had received the incorrect prescription by mail on August 8, 2024.
