Woman Awarded Rs 3 Lakh for Medical Negligence After C-Section
20 Oct
Summary
- Gynaecologist and hospital found liable for medical negligence.
- Woman suffered pain and bleeding for months post-Caesarean delivery.
- Commission awarded Rs 3 lakh compensation and Rs 11,000 costs.
A Haryana consumer commission has ruled that a gynaecologist and a hospital committed medical negligence. This decision came after a woman experienced prolonged pain and bleeding for months following her Caesarean delivery in February 2022.
The commission found that the doctor failed to perform essential investigations, such as an ultrasound, to diagnose the cause of the persistent symptoms. This lack of timely investigation led to further complications and expenses for the patient.
The woman reported ongoing abdominal pain and bleeding after her discharge on February 21, 2022. Despite subsequent visits and procedures, including a dilation and curettage on June 4, 2022, her symptoms persisted, requiring further treatment at another hospital later that year.
In its October 12 order, the commission highlighted the doctor's failure to follow medical protocols and reliance on guesswork, noting discrepancies in the hospital's defense. The failure to provide complete medical records was also deemed a critical oversight.
As a result of the negligence and unfair trade practices, the commission directed the gynaecologist and hospital to pay Rs 3 lakh in compensation for medical expenses and mental agony, along with Rs 11,000 for litigation costs.
