Maharashtra FDA Bans Baby Formula Ads, Imposes Fines

The Maharashtra Food and Drug Administration (FDA) has implemented stringent new regulations for infant nutrition products, including formula milk. Effective immediately, all infant formula packaging must prominently feature the message 'IMPORTANT NOTICE & MOTHER'S MILK IS BEST FOR YOUR BABY.' The FDA has also prohibited the advertising of formula milk, infant foods, free samples, gifts, cashback offers, and influencer or social media promotions.
These comprehensive rules, aimed at protecting vulnerable consumers, apply across the entire supply chain from manufacturers to e-commerce platforms. Violations such as misleading advertisements or operating without a license can incur fines of up to Rs 10 lakh. Substandard food may result in a Rs 5 lakh fine, and misbranding up to Rs 3 lakh. Additionally, the use of preservatives, added colors, and flavoring substances in infant food is now banned, with strict limits on added sucrose.
