FDA OKs Fruit Vapes, But Shore Says No
15 May
Summary
- New Jersey law bans most flavored vape sales.
- State beaches and boardwalks prohibit vaping statewide.
- Pennsylvania and Delaware have varied vape flavor regulations.

The Jersey Shore will experience a summer largely free of fruit-flavored vapes, even with the FDA's recent authorization of 45 new flavored e-cigarette products. Although these fruit-flavored options are now legal federally for adults, New Jersey's state laws effectively restrict their availability. Stores in New Jersey are barred from selling most flavored vaping products, including fruit and candy varieties. Furthermore, vaping and smoking are prohibited on public beaches, boardwalks, and most parks statewide, with potential fines for infractions.
Pennsylvania's regulations are less strict regarding flavored vape sales, allowing some of the FDA-authorized products potentially to appear on shelves. However, the state mandates that retailers purchase only from licensed in-state wholesalers, and an Attorney General directory will determine which nicotine vapes are legal. This is expected to limit sales to major, authorized brands. Delaware offers a middle ground, permitting some flavored vape sales without a blanket ban but restricting public use in indoor spaces and banning sales to minors. Many Delaware beach towns also prohibit smoking and vaping on sand and boardwalks.
