Delhi Court Orders Removal of Open Garbage, Urinal

The Delhi High Court recently declared that an open garbage bin and a public urinal situated in a residential area infringe upon the fundamental right to life, as guaranteed by Article 21 of the Constitution. Justice Amit Bansal issued a directive to the Municipal Corporation of Delhi (MCD), ordering the removal of these facilities from the petitioners' neighborhood in Sita Ram Bazar within a four-week timeframe, effective from February 16, 2026.
The case originated when a resident approached the court after an open garbage bin and a public urinal were installed directly outside his home, serving approximately 150 local residents. Despite repeated requests for improved sanitation, the petitioner's concerns remained unaddressed.
An earlier court order in August 2025 for removal was met with the MCD's report deeming alternative sites infeasible and asserting regular cleaning of the urinal. However, the court found these measures insufficient, concluding that the unsanitary conditions created a "deplorable condition" for the local residents.
