Court Orders Pregnancy Termination for Fetus with Severe Abnormalities
31 Jan
Summary
- Pregnancy termination allowed due to severe fetal abnormalities.
- Court ruled denying termination may prolong family suffering.
- Hospital must provide full care if the fetus survives birth.

Justice Shoba Annamma Eapen has authorized the termination of a pregnancy based on a medical board's findings. The board reported that the fetus would likely suffer serious physical abnormalities if born, and continuing the pregnancy posed risks to the mother's mental health.
The court determined that refusing the termination might only extend the family's distress. Consequently, it instructed the Kottayam Medical College to proceed with the procedure, emphasizing the need for a final scan to confirm fetal abnormalities.
Should the fetus survive birth, the hospital is obligated to provide comprehensive assistance, including specialized treatment, to ensure its survival. The medical team will use their best judgment to perform the termination safely. The family will assume responsibility for the baby's expenses and care.
