Summary
- New Jersey levied a $1.07 million fine on DataOne for unpermitted gas generators.
- Sixty-two generators were installed without required environmental permits.
- DataOne must obtain permits within 45 days but can continue operation.

New Jersey has levied a substantial $1.07 million fine against the DataOne campus, marking a significant enforcement action for environmental non-compliance. The data center allegedly installed 62 natural gas generators without obtaining required preconstruction permits and operating certificates.
The discovery was made after a local farmer observed the equipment, leading to an investigation that utilized thermal drone technology. Officials confirmed that neither permit nor operating certificate was secured for any of the 62 units. This facility is preparing to support Microsoft's AI infrastructure later this year, a venture from the Dutch cloud AI company Nebius.
State authorities emphasized the importance of accountability in data center operations, aiming to protect communities and the environment. DataOne has stated it disagrees with the temporary generator determination but will pursue the necessary air permits. They are in communication with the Department of Environmental Protection and have been granted 45 days to obtain the relevant permits while continuing operations.
