The National Green Tribunal (NGT) has initiated proceedings against the National Highways Authority of India (NHAI) for constructing a highway over protected pond sites. The tribunal questioned whether the village pond in Goyla Khurd was a protected wetland and if NHAI's construction violated environmental norms.
The Delhi Wetland Authority confirmed the waterbody is a protected wetland. Evidence showed NHAI constructed eight pillars within the pond, encroaching upon 2.36 sq metres, despite the environmental clearance not mentioning any such construction. This action contravened Rule 4 of the Wetlands Rules, prohibiting encroachment and permanent construction.
While acknowledging the need for sustainable development and infrastructure, the NGT stressed adherence to law and disclosure of facts. NHAI's counsel committed to restorative measures. The NGT directed the Ministry of Environment, Forest and Climate Change to review the environmental clearance violation.
Furthermore, a joint inspection will assess damage from muck and construction, with NHAI responsible for rejuvenation steps and environmental compensation. NHAI must ensure full disclosure of affected natural resources in future applications.
