NGT Revokes Clearance for Viman Nagar Project
9 Oct
Summary
- NGT cancelled Viman Nagar project's EC due to flawed EIA report.
- The EIA failed to provide point-wise responses to project Terms of Reference.
- Environmental clearance granted on February 9, 2024, has been set aside.
The National Green Tribunal (NGT) has invalidated the environmental clearance granted for an expansion project in Viman Nagar. The Western Zonal Bench found the Environmental Impact Assessment (EIA) report to be deficient, specifically noting its failure to offer point-wise responses to the project's Terms of Reference (ToR). This led to the revocation of the clearance originally issued on February 9, 2024, by the State Level Environment Impact Assessment Authority (SEIAA) of Maharashtra.
The project, initially cleared in March 2019, sought expansion after SEIAA noted discrepancies between approved plans and actual construction. This prompted the project proponent to reapply under violation procedures. Despite SEAC recommending clearance after assessing penalties and seeking specific environmental measures, the NGT identified significant flaws in the EIA, deeming it too brief and incomplete.
An MPCB inspection in September 2025 revealed completed buildings occupied and operational commercial facilities. However, remediation and resource augmentation plans had reportedly not commenced. The NGT has now ordered SEIAA to reconsider the application for ex-post facto clearance within two months.
