NAACP Sues Musk Over AI Data Center Health Risks
15 Apr
Summary
- NAACP alleges AI company's Tennessee/Mississippi data centers pose health risks.
- Lawsuit claims gas turbines operate without air permits, violating Clean Air Act.
- Pollution linked to increased asthma, respiratory issues, and heart problems.

The NAACP filed a lawsuit on Tuesday against Elon Musk's artificial intelligence company, xAI, and its subsidiary MZX Tech. The suit alleges that the operation of gas turbines at a data center in Southaven, Mississippi, without a required air permit, constitutes a violation of the Clean Air Act and poses health risks to residents.
The organization contends that the turbines emit hazardous pollutants linked to an increase in respiratory diseases, heart problems, and certain cancers. This legal action comes amid broader public concern over data center construction, with lawmakers in over ten states proposing temporary bans due to issues like energy consumption and noise pollution.
Musk's AI ventures in the region include the "Colossus" supercomputer data center in Memphis and plans for an even larger facility, Colossus 2. While promising economic benefits, the data centers are also criticized for their significant water and electricity consumption, potentially outweighing the few hundred jobs they are expected to create.
The NAACP's lawsuit, filed in the Northern District of Mississippi, notes that xAI has located these power plants in communities with substantial Black populations. The company has not yet responded to requests for comment.
