Uttarakhand HC Upholds NCC Unit Withdrawal Due to Poor Performance
2 Nov
Summary
- College student strength below 40 for two years in higher classes.
- Only 10 of 20 vacant NCC seats filled during enrollment drive.
- Three cadets failed 'B' certificate exam; associate NCC officer showed no interest.
The Uttarakhand High Court recently dismissed a petition filed by CRST Inter College, Nainital, challenging the National Cadet Corps (NCC) unit's withdrawal. Acting Chief Justice Manoj Kumar Tiwari ruled that the decision was not arbitrary.
The college had sought the quashing of a June 11, 2024, order that withdrew its NCC unit. The NCC Directorate, Uttarakhand, cited severe disinterest and low enrollment as reasons for the withdrawal. Specifically, student strength in Classes 11 and 12 remained below 40 for two consecutive years.
Further evidence presented included an enrollment drive in August 2022 where only 16 students appeared for 20 vacant seats, with only 10 deemed suitable. Additionally, academic and operational performance was poor, with three NCC cadets failing their 'B' certificate examination in February 2023. The associate NCC officer also demonstrated a complete lack of interest and did not participate in any activities.
The High Court noted that the college did not refute the counter-affidavit filed by the NCC Directorate, treating its averments as undisputed facts. Consequently, the court held that the withdrawal decision did not warrant judicial interference and dismissed the writ petition.
