A tugboat captain, Yusiel Lopez Insua, 46, faces a charge of seaman's manslaughter in connection with a deadly collision that occurred in July. The incident involved a tugboat pushing a barge filled with construction debris in Biscayne Bay. Federal prosecutors stated that Insua lacked a clear view and had no assigned lookout as the tugboat proceeded.
The sailboat, carrying a counselor and five girls, stalled directly in the barge's path. Insua failed to see the sailboat before the collision. The counselor and two girls managed to escape after being dragged under the barge, but three girls became trapped and drowned.
Investigators are also looking into cellphone usage by Insua around the time of the collision, with evidence suggesting internet access was used.
