McGuinness alleged that as she reached the bottom of the 214-foot slide, she became airborne and experienced forceful impact, leading to "severe vaginal lacerations" and internal organ damage. Disney denied these claims, asserting the ride's safety and suggesting the injuries may have pre-existed the incident. The company noted that similar, though less severe, incidents had been reported previously.
The dismissal occurred just before the trial was scheduled to commence on January 5, 2026, in a Florida court. Court records do not specify if a settlement was reached, but McGuinness' deposition was canceled, and the trial removed from the calendar.
