The court stated that the buildings are not safe for habitation and that the residents would be responsible for any mishaps if they choose to remain.
Granting a temporary exception, the court allowed 9 residents to stay in their flats until August 25, but at their own risk. The court made it clear that those who voluntarily vacate their homes before the deadline will be permitted to do so.
The residents had alleged that the Delhi Development Authority (DDA) was trying to hide its "criminal acts" by getting the flats vacated and demolished, as this would remove evidence of inferior construction quality and other lapses that were to be used in pending criminal cases. They also claimed that the Lieutenant Governor had directed the Central Bureau of Investigation to probe the DDA officers involved in the scam.
However, the court dismissed these arguments, stating that they had been dealt with earlier when a single judge had cleared the way for the demolition of the structure. The court criticized the DDA's "callous" conduct and its failure to fulfill its obligations as a public agency.
