Appeals Court Backs Weinstein's Rape Conviction
27 Jun
Summary
- Appeals court upheld Harvey Weinstein's 2022 rape conviction.
- The court ordered that Weinstein must be resentenced.
- Weinstein's spokesman stated they would continue to appeal.

A state appeals court has affirmed Harvey Weinstein's 2022 rape conviction. However, the court has vacated his sentence and remanded the case for resentencing, stating, "In all other respects, the judgment is affirmed."
Weinstein was found guilty in December 2022 of three counts of sexual offenses, including rape. He was subsequently sentenced to 16 years in prison in February 2023.
His spokesperson, Juda Engelmayer, indicated that Weinstein will continue to pursue further appeals, citing "significant legal issues" that warrant continued consideration. Engelmayer added, "We are disappointed by today's decision and respectfully disagree with the court's conclusions."
The appeals court ruling was issued just one day after prosecutors in New York decided not to proceed with a fourth trial against the former producer.
Weinstein has been incarcerated since 2020, following widespread allegations from over 100 women accusing him of sexual assault and harassment, which helped spark the #MeToo movement in 2017.
