Weare Man Defends Firing Shot at Car on His Land

A Weare man, Michael Durgin, testified in his own defense on a felony charge of reckless conduct with a deadly weapon. He is accused of firing a bird gun at a vehicle driven by a 25-year-old man who had mistakenly entered his property in October 2024.
Durgin stated he grabbed his 12-gauge shotgun after hearing his wife scream and gunshots, not knowing she had already fired. He testified that he aimed at the rear tire of the car, believing his wife's life was in danger, and intended to disable the vehicle to investigate.
His wife, Diane Durgin, also faces serious charges, including assault with a firearm and criminal threatening. She allegedly made racial slurs and fired shots at the driver, claiming self-defense. The driver had arranged to pick up a car part online and inadvertently arrived at the wrong address on Colby Road.
The trial, presided over by Judge David Anderson in Hillsborough County Superior Court, is nearing its conclusion. Closing arguments were expected the morning after Durgin's testimony.
