Court Jails Officer for Arresting Protected Man
19 Sep
Summary
- Former ACP jailed for one month for disobeying court.
- Officer arrested businessman despite court protection.
- Sentence suspended for four weeks for appeal filing.
A former Assistant Commissioner of Police, A Krishnaiah, has been sentenced to one month of simple imprisonment by the Telangana High Court. This ruling stems from his wilful disobedience of court orders, specifically the unlawful arrest of a businessman named Katta Vamsi Krishna. The court had previously issued an interim order protecting Vamsi Krishna from arrest in a dowry death case registered in April.
Despite the subsisting court protection, the former ACP proceeded with the arrest, an action the High Court deemed a clear violation of its directions. Justice K Sujana found Krishnaiah guilty, imposing a fine of Rs 2,000 alongside the imprisonment. However, the court suspended the sentence for four weeks, providing the officer an opportunity to file an appeal against the decision.
Contempt proceedings against a sub-inspector involved were dropped, as he was found to have had no direct role in the arrest. The court emphasized that officers are obligated to verify the status of court orders through official channels before making an arrest, even when dealing with serious offenses. Krishnaiah's explanation of being unaware of order extensions and acting under pressure was rejected by the judge.
