D'Silva, aged 36, was sentenced to one year, one month, and six days of rigorous imprisonment. This sentence period has already been completed by the accused. He was also fined ₹1,000, with an additional month of imprisonment if the fine is not paid.
He was apprehended on January 13, 2025, at a Kashigaon hotel without a valid passport or visa. During police inquiry, he could not provide proof of Indian citizenship. The court noted the legal onus was on him to prove his nationality.
While convicted for illegal stay, D'Silva was acquitted of charges related to cheating, forgery, and passport violations due to insufficient evidence. After serving his sentence, he is ordered to be deported to Sri Lanka.
