Predator's Appeal Fails: Jail Term Upheld for Sexual Assault
1 Jun
Summary
- Man convicted of choking woman unconscious and sexually assaulting her.
- Key evidence was a secret recording by a tattoo artist for another investigation.
- His appeal failed, upholding a 4.5-year sentence for sexual assault.

Kenneth Dauphinais, 51, will continue serving a 4.5-year sentence for sexually assaulting a woman after his appeal was dismissed. He had choked the woman unconscious and assaulted her in 2008.
The Saskatchewan Court of Appeal upheld his conviction, rejecting all his claims. This decision provides significant relief to the survivor, who testified against him.
A pivotal piece of evidence was a secret recording of Dauphinais speaking with a tattoo artist in 2017. The artist, unaware she was cooperating with police, inadvertently captured details of the assault.
Dauphinais was also investigated for the 2002 murder of his wife, Terrie Ann Dauphinais, in Calgary. However, the second-degree murder charge was stayed in February 2021 after key evidence from a Mr. Big sting operation was ruled inadmissible.
The sexual assault trial took place in 2024, where the judge did not believe Dauphinais's testimony denying the assault. The survivor expressed hope that this conviction will prevent future harm to other women.
