17 Sep
Summary
- Rajasthan High Court set aside a divorce decree, restoring a couple's marriage.
- Reconciliation occurred voluntarily during the appeal process, guided by the court.
- The couple prioritized their minor daughter's welfare in reuniting.
In a significant ruling, the Rajasthan High Court has overturned a divorce decree, reinstating the marriage of a couple from Hanumangarh. The decision was made by a Division Bench comprising Justice Sameer Jain and Justice Uma Shanker Vyas at the principal seat in Jodhpur.
The court's judgment on September 15 noted that legal proceedings should not prevent reconciliation when parties mutually decide to reunite. The case involved Saraswati and Amit, who were married on October 23, 2015. They had appealed a family court's November 30, 2024, order that dissolved their marriage.
During the appeal, mediation was attempted but did not yield a settlement. However, discussions facilitated by the High Court and the parties' personal appearances led to a voluntary mutual settlement. Both Saraswati and Amit expressed their desire to end their differences and resume their matrimonial relationship.
A key consideration for the bench was the welfare and future of their minor daughter. The couple wished to rebuild their family life, providing their daughter with the emotional security of both parents. The court affirmed that the law should support peace and restoration when spouses freely choose to resume their relationship.
