A pensioner has died following a nighttime burglary of his London home, with the accused burglar denying murder charges. John Burke, 86, who had dementia, died on September 30, 2025, a day after his home in Hackney was broken into in the early hours of September 29, 2025.
The Old Bailey heard that Ashley Malcolm, 40, is accused of murdering Mr. Burke, allegedly headbutting him during the incident. The court was informed that Malcolm had also broken into two other properties and attempted to burgle a fourth on the same morning, reacting violently when confronted.
Malcolm allegedly entered Mr. Burke's flat shortly before midnight and returned later that morning. Evidence includes CCTV footage, forensic reports, and post-mortem examinations. The prosecution contends that the assault on the "frail and vulnerable" pensioner was intended to cause serious harm. Malcolm has admitted to some burglaries but denies murder and manslaughter.
The defendant's actions on that day also included confronting a support worker at a care home and violently assaulting a couple when attempting to burgle their flat. Mr. Burke had reportedly told healthcare workers and paramedics that he had been "beaten up" and "attacked" by two men, including being headbutted.
