A man accused in a February shooting death outside the Savoy Nightclub in Orlando is requesting release from jail following the emergence of new video evidence. The footage shows Jean Borja was inside his car when the shot that killed Julian Cruz was fired.
Investigators confirmed the video depicts a physical altercation that occurred before the gunfire. The conflict began when Cruz and his partner accused Borja of speeding and nearly hitting them with his vehicle. This led to a fight where Borja was taken to the ground.
Upon rising, Borja walked to his vehicle and entered it. Cruz and his partner followed him to the car door. Prosecutors allege the partner was partially inside the vehicle when the shot was discharged.
The defense is exploring a Stand Your Ground defense, asserting the circumstances constitute self-defense. However, prosecutors argue Borja initiated the incident by stopping his car to confront the couple, thus disqualifying it as self-defense. They also claim the victim and partner were attempting to close the car door.
Borja's legal team is using this new video evidence to support their request for his release pending further legal proceedings.
