A man has been sentenced to three years rigorous imprisonment for breaking into a Mumbai home and stealing jewelry worth Rs 4.80 lakh. The incident, which occurred in November 2024, saw the accused, Fardeen Firdos Khan, convicted under the Bharatiya Nyaya Sanhita. His co-accused was acquitted due to insufficient evidence.
The court found that the door lock was broken and valuable gold ornaments, including a mangalsutra, were missing. The defense did not contest the facts of the housebreaking and theft. The recovery of the stolen mangalsutra at the behest of Fardeen, while he was in police custody, played a crucial role in the conviction.
Fardeen confessed to the theft and led authorities to his residence where the stolen gold was recovered. The magistrate emphasized that possession of recently stolen property, without a credible explanation, creates a presumption of guilt.
