Summary

- Ossification tests confirmed both men were minors at the time of crimes.
- The court ruled minors cannot serve more than seven years for murder.

In a significant ruling, the Calcutta High Court has ordered the release of a Bangladeshi national who spent 21 years incarcerated for murder. This decision came after ossification tests established that he was a minor when the crime occurred.
Similarly, another murder convict from Birbhum, having served 14 years, was also freed on the grounds of his juvenile status at the time of the offense. The court emphasized that the Juvenile Justice (Care and Protection of Children) Act limits sentences for minors to a maximum of seven years.
The court directed the repatriation of the Bangladeshi national. The appeals for both individuals were heard by a division bench. Reports from additional district and sessions judges confirmed their ages at the time of the offenses, leading to their release after prolonged imprisonment.
