Mark Walter, owner of the Los Angeles Dodgers and Lakers, is currently under investigation by U.S. prosecutors in Manhattan concerning potential financial improprieties. The Securities and Exchange Commission is conducting a parallel inquiry into two insurance companies controlled by Walter, Delaware Life Insurance Co. and Clear Spring Life and Annuity Co., as well as his firm Guggenheim Partners.
At the core of the investigation are billions of dollars managed by Walter's insurers, primarily composed of customer funds from retirement annuities and life insurance policies. Prosecutors are examining whether these funds, invested in private loans to businesses, were secretly linked to Walter's own companies without proper disclosure. This scrutiny is crucial as it affects the safety net for policyholders.
Filings revealed that Delaware Life initially reported only about 3% of its investments, approximately $1.4 billion, were connected to Walter's entities. However, internal findings later indicated this figure was at least 39%, amounting to over $17 billion. This means the insurer's money was about 12 times more intertwined with Walter's other businesses than previously communicated to regulators.
In response to these revelations, Delaware Life is developing a plan to untangle these connections and enhance its bookkeeping. S&P Global Ratings adjusted its outlook for Delaware Life from stable to uncertain, though the company retains an A- grade. The FBI also executed a search warrant in September. Group 1001, the parent company of the insurers, stated it is cooperating and maintains strong capital and liquidity.
While these investigations do not currently affect the Dodgers or Lakers, the timing is notable as the NBA recently approved Walter's purchase of the Lakers. Historically, such investigations rarely lead to formal charges.
