Kelsey Fitzsimmons, a 29-year-old former North Andover Police officer, is currently on trial for assault with a dangerous weapon. The charges stem from a chaotic incident in June 2025 when officers arrived at her home to serve her with a restraining order.
Prosecutors allege Fitzsimmons, devastated by the restraining order from her fiancé, Justin Aylaian, pointed her service weapon at responding officers. Aylaian had claimed Fitzsimmons was mentally unstable and had threatened him and their four-month-old son, seeking sole custody.
Fitzsimmons' defense asserts her intention was to commit suicide due to the fear of losing her child. She denies aiming the gun at her fellow officers. The defense contends that if she did pull the trigger, it was an act of self-harm.
The prosecution claims the gun had a full magazine but did not fire because the chamber was empty, and that Officer Pat Noonan shot Fitzsimmons in self-defense as she lunged for the weapon and pulled the trigger. Fitzsimmons sustained a collapsed lung and was hospitalized for several weeks after being shot in the chest.
Testimony from Lt. Sean Daley indicated he heard Noonan say, 'Don't do it Kelsey,' before gunshots were heard. Fitzsimmons reportedly told officers while injured, 'I'm sorry, I want to die.' Footage showed Aylaian fleeing the home before gunshots. Fitzsimmons was fired from the police department following the incident.
