Ex-CEO Cleared on Two of Three Misconduct Allegations

Cindy Donovan, the former CEO of Loch Lomond Villa, has been cleared of two of three professional misconduct allegations. These charges stemmed from the discharge of an 83-year-old resident in April and May 2021. The College of Nursing of New Brunswick's discipline committee found Donovan, a registered nurse, guilty of failing to safeguard personal and family information.

This upheld allegation relates to a letter Donovan issued to other residents and their families regarding the discharge. Although the resident was not named, the letter contained identifying details. Donovan's lawyer argued the letter was a response to significant media coverage initiated by the resident's family.

Two other allegations against Donovan, concerning respect for the patient and communication with the family, were dismissed. These focused on alleged communication breakdowns and the circumstances of the resident's discharge from the nursing home without an alternative placement arranged, leading to hospitalization.

The committee is now considering submissions on the appropriate penalty for the privacy breach. The college's counsel suggested a reprimand, privacy courses, and costs, while Donovan's defense argued for a less severe outcome, citing the emotional toll and legal counsel involvement in the letter's creation.
