Lil Durk Wins Key Ruling: Chicago Charges Severed for Trial

U.S. District Court Judge Michael W. Fitzgerald has granted rapper Lil Durk a significant legal victory, agreeing to sever newly filed racketeering charges from his upcoming trial in Los Angeles, scheduled for August 20, 2026. These severed charges include allegations related to a January 2022 killing in Chicago and a February 2019 attempted murder in Atlanta.

The judge determined that introducing these new counts through a third superseding indictment last month left the defense with insufficient time to prepare. Prosecutors had previously withdrawn evidence of the Chicago incident from the Los Angeles trial, a decision the judge upheld.

Lil Durk, born Durk Banks, has been in custody without bail since his arrest in October 2024. His defense team argued that the sweeping new charges were a "clever attempt" to prejudice the jury, and that Banks, who has a right to a speedy trial, was ready to proceed based on the prior indictment.

The original charges stem from an alleged August 2022 murder in Los Angeles, where prosecutors claim Banks ordered the killing of Saviay'a Robinson. Prosecutors assert this was retaliation for the 2020 death of his friend, King Von. The defense maintains Banks' innocence and looks forward to the August 20, 2026 trial.

Robinson's mother expressed her grief, noting her son's family and three children will never know their father. The judge instructed both parties to confer on a new trial date for the severed charges, acknowledging the potential for double jeopardy claims if Banks is acquitted in the initial trial.
