A California family has initiated legal proceedings against the Bay Club in El Segundo, Los Angeles, following an incident on March 17, 2025, where their 23-month-old son was allegedly thrown by a childcare worker. Surveillance video appears to show the employee swinging the toddler between her legs before lifting him overhead and releasing his hands, causing him to fall approximately 6 feet to the hardwood floor.
The toddler reportedly sustained a traumatic brain injury, including a concussion and facial abrasions, and was taken to the emergency room the same day. The lawsuit states that the child continues to experience symptoms, such as hearing loss, over a year after the event.
Parents allege the Bay Club misrepresented the incident, initially claiming an employee "fell over" and the child fell from a much lower height. The complaint asserts this account was intentionally false, as proven by the surveillance footage. Despite gym daycares typically being exempt from licensing if parents remain on-site, the suit argues the Bay Club should have been licensed, especially as parents were permitted to leave for a nearby club.
Attorney Ryan Saba condemned the alleged deception, stating, "The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable." The Bay Club has stated they cannot comment on ongoing litigation but emphasized that member and family safety is their highest priority.
