The Karnataka High Court has ordered the immediate release of a 29-year-old Bengaluru man who was wrongly jailed for six months. Justice M. Nagaprasanna termed the police's actions in invoking the abetment to suicide provision of the Bharatiya Nyaya Sanhita (BNS) as "recklessness and mechanical prosecution." The court also mandated a departmental inquiry against the police inspector responsible for filing the charge-sheet.
The case originated from a domestic harassment complaint filed by the man's wife. Following a quarrel on October 20, 2025, she attempted suicide by jumping from their residence, surviving with injuries. She subsequently lodged a complaint. However, the court highlighted that Section 108 of the BNS requires an actual suicide, a condition not met in this instance, as the wife was alive and healthy.
Justice Nagaprasanna criticized the charge-sheet as a "glaring manifestation of non-application of mind," emphasizing that the criminal justice system should not operate on arbitrary whims. The court quashed the criminal proceedings, noting that the petitioner and his wife had amicably settled their matrimonial dispute and intended to resume their relationship.
