Japan OKs Shared Custody for Divorced Couples
1 Apr
Summary
- Divorced couples can now opt for shared custody or sole custody.
- Divorces finalized on or after April 1 will see new child support rules.
- The revised law emphasizes parental cooperation for child welfare.

Japan has enacted a landmark revision to its Civil Code, permitting divorced couples to share custody of their children from Wednesday, April 1, 2026. This reform allows separated parents to mutually agree on joint or sole custody arrangements, a major departure from the previous law that mandated single-parent custody.
The amended law stresses parental cooperation, emphasizing that both parents should work together for their child's best interests. Major decisions like relocation and education require joint agreement, while day-to-day matters can be handled by one parent. If parents cannot agree, family courts will decide, prioritizing the child's welfare.
For divorces finalized on or after April 1, 2026, a new child support system offers a monthly payment of 20,000 yen per child. Child support claims will also gain priority over other debts, ensuring more effective collection. The revision aims to provide more robust support and protect children's well-being post-divorce.
