The Orissa High Court recently mandated a compensation of Rs 30,000 for an individual subjected to illegal arrest and detention. This unlawful detention occurred due to a forged non-bailable warrant. The court also directed the sub-divisional judicial magistrate in Bhubaneswar to investigate the origin of the forged warrant and implement necessary actions.
Justice R K Pattanaik issued this directive on July 23rd, addressing a petition from the man who claimed he was illegally apprehended, detained, tortured, and assaulted by police. He asserted the warrant used was fraudulent. The police contended they acted upon receiving a photocopy of the warrant via Speed Post, which bore a counterfeit court seal.
Following an inquiry, the judicial magistrate confirmed that no such warrant was issued by their court. The High Court, reviewing reports and case diaries, concluded that a "mischief" had occurred, resulting in the petitioner's illegal arrest. The compensation is to be recovered from responsible officers or staff after the probe concludes.
