A Danish grandmother has been handed a suspended prison sentence for posting photos of her grandson's birth on social media, after her daughter reported her to the police. The images, which included the mother during labour and the newborn immediately after birth, were shared on Facebook without consent. Years after the birth, the mother discovered the photos and demanded their removal.
Despite her daughter's request, the grandmother re-posted the same images online, leading to a formal complaint and criminal proceedings. The Odense District Court sentenced the 50-year-old to 14 days imprisonment, suspended, and ordered her to pay 10,000 kroner in damages for the distress caused.
This ruling follows a similar 2020 case in the Netherlands where a grandmother was ordered to delete photos of her grandchildren posted online without parental permission. The court in that instance cited the EU's General Data Protection Regulation (GDPR), noting that posting on social media exempts the processing from 'purely personal' use.
