Florida Jails Harm Mentally Ill: Lawsuit Filed

A federal civil rights lawsuit has been filed in Miami against the state of Florida and its Department of Children and Families. The suit contends that individuals found incompetent to proceed in criminal cases due to mental illness are suffering unconstitutional punishment by languishing in county jails for months. This practice significantly exceeds the 15-day limit mandated by Florida law for transfer to state hospitals for treatment.

Disability Rights Florida, the Southern Poverty Law Center, and the Florida Justice Institute are co-plaintiffs, arguing that the Department of Children and Families abandons these vulnerable individuals. The lawsuit highlights that the average wait for treatment is over 115 days, with some cases extending to six months or longer. This delay exacerbates mental health symptoms, causes physical harm, and has tragically led to at least three deaths in custody while awaiting treatment.

Advocates emphasize that jail facilities are ill-equipped to provide necessary mental health care, leading to instances of restraint, Tasering, and pepper spray. They argue that a lack of funding is an insufficient excuse for violating constitutional rights. The lawsuit seeks to compel the state to address this long-standing crisis, which has persisted for decades and continues to endanger those awaiting court-ordered mental health services.
