An 84-year-old man, John McColl, tragically died in February 2025 after being attacked by an XL Bully dog on a driveway in Warrington. The court was informed that the dog, named Toretto, had not been fed and exhibited extreme aggression.
Prosecutors described the attack as being so severe that the dog 'ate him alive,' with parts of Mr. McColl's face found in its stomach. Despite attempts by bystanders to help, the powerful dog would not release its victim.
Armed police officers engaged the animal, firing a total of ten shots from a pistol and shotgun to subdue Toretto. A second XL Bully, Malibu, was also present and was shot by police as a precaution.
The dog's owner, Sean Garner, 31, admits to possessing two XL Bully dogs without an exemption certificate but denies being the owner of the dog responsible for the fatal attack.
Garner reportedly made light of the situation following the incident and initially claimed the dogs were not XL Bullies. Evidence presented suggested the dogs were not kept as claimed, and text messages indicated Garner was aware of Toretto's dangerous temperament due to improper feeding.
