Driver Claims Prescribed Meds, Not Drugs, After Hitting Guard

A Nassau County Police crossing guard remains in critical condition after being struck by a driver on Thursday morning. The incident occurred at Sunrise Highway and Merrick Avenue on Long Island.
The injured guard, identified as 70-year-old John Miro, was on the sidewalk when he was hit. He suffered broken ribs, a skull fracture, and brain injuries, and is currently in the ICU. His family stated he is "not doing well" and "clinging to life."
The driver, 30-year-old Joshua Alvardo, appeared in court on Friday. Prosecutors allege Alvardo was impaired by drugs while driving to work and passed out behind the wheel. They stated he lurched his vehicle forward, hitting Miro after other drivers honked.
Alvardo's defense attorney argued the crash was an accident, not a crime, claiming his client had taken prescription medication the night before for anxiety and pain stemming from a prior assault. Blood test results are still pending.
Bail was set for Alvardo at $500,000 or a $1.2 million bond. Colleagues and community members remembered Miro as a friendly and happy person who was always willing to help.
