Summary
- Doctor ordered to pay Rs 72,500 for medical negligence.
- Woman became pregnant despite undergoing a tubectomy procedure.
- Commission found doctor liable for medical negligence and deficiency.
A doctor in Giridih, Jharkhand, has been held liable for medical negligence and deficiency in service by the District Consumer Disputes Redressal Commission. The commission directed the doctor to pay a total of Rs 72,500 to a woman who became pregnant despite undergoing a tubectomy procedure at his clinic on December 14, 2022. The woman had paid Rs 15,000 for the alleged sterilization.
Despite the procedure, medical tests on August 26, 2023, revealed the woman was pregnant, leading her to file a complaint. The doctor denied the allegations, stating that tubectomy procedures have a failure rate and that the patient was informed of this possibility. However, the commission found insufficient evidence to rebut the complainant's claims of negligence.
The commission ordered the doctor to refund the Rs 15,000 fee, pay Rs 50,000 as compensation for mental and physical agony, and Rs 7,500 for litigation costs. This case underscores the importance of due care in sterilization procedures and potential liability for doctors in cases of proven negligence.
