Dowry Death Conviction: Cruelty Proven Beyond Doubt
30 Aug
Summary
- Man convicted for dowry death after wife's hanging in 2021.
- Court found direct link between dowry demands, cruelty, and death.
- Accused demanded money for gambling and drinking habits.

A Delhi court has convicted Surender Yadav for dowry death, establishing a clear connection between dowry demands, cruelty, and the demise of his wife, Pooja. The conviction under Sections 304B and 498A of the Indian Penal Code comes after the prosecution proved beyond reasonable doubt that Pooja was subjected to cruelty and harassment shortly before her death.
Pooja was discovered hanging in her Palam Colony matrimonial home on January 5, 2021. The court's verdict highlighted that Yadav, a gambler and drinker, frequently assaulted Pooja and demanded money. A crucial piece of evidence was Pooja's phone call to her father two days prior, detailing three days of continuous beating over money demands.
The court dismissed Yadav's defense, which cited depression from financial hardship during the Covid pandemic as the cause of suicide. It emphasized the immediate and direct link between the dowry demands and the cruelty Pooja endured. The judge noted that the absence of independent witnesses was not detrimental, as such harassment often occurs within the confines of a home.
The matter is scheduled for September 7 for arguments on sentencing. Conviction under Section 304B carries a minimum of seven years imprisonment, potentially extending to life imprisonment.
