A special court in Mumbai granted default bail to Jitendra Mahadev Yadav, an accused in a Rs 3.16 crore fraud case, on Tuesday. Yadav was arrested on July 12, 2025, after absconding for two years. The court ruled that the prosecution failed to file the chargesheet within the 60-day period mandated by law for the initial charges.
The court emphasized that adding a more severe section, like Section 409 of the IPC, on the expiry of the 60-day limit did not reset the timeline for filing the chargesheet. This decision highlighted that the deadline for submitting the chargesheet begins strictly from the date of arrest, and late amendments to charges cannot override this established right to liberty.
Judge Vikram R Jagdale stated that an indefeasible right to default bail accrued to Yadav on September 9, 2025, as the chargesheet was not filed by then. The court imposed conditions on the bail, including a Rs 1 lakh personal bond and Rs five lakh cash security, along with surrendering his passport and restrictions on leaving the court's jurisdiction.
