Man accused of fraud framed loan as 'philanthropy'

Daniel Bard is facing a retrial for 19 charges, including fraud, theft, and money laundering, which began on January 20th. Clinton Davis, a Dieppe business owner, testified that Bard presented a loan agreement as a philanthropic offer to 'give back and help out.' Davis recounted that Bard, who was then vice-president of investment attraction at a local economic development agency, offered access to a multimillion-dollar loan.

In exchange for $25,000 US, Bard proposed facilitating a credit enhancement loan of six to ten million dollars to create a new salon franchise, a factory, and a beauty school. Davis found the offer 'scary' and 'confusing,' but Bard's explanation of a successful career and impending retirement as a philanthropist instilled some faith. A letter of intent promised the loan was refundable if the project did not proceed.

Despite signing the deal and paying Bard, the larger loan was never secured. Bard became unreachable, offering repeated reassurances that the deal was imminent. Davis expressed fear in speaking up due to a clause in the letter of intent that threatened forfeiture of the money if they backed out. Meanwhile, the Davises incurred significant debt while launching another salon, anticipating Bard's promised funding.

During cross-examination, Bard's lawyer questioned Davis about his wife's advocacy campaign against Bard, which she reportedly began after their experience. Davis stated his wife sought justice, and similar experiences were shared by others who reached out to her. Davis also testified that his own motivation was to prevent Bard from harming others.

Detective Sgt. Patrick Lemerise testified as the lead investigator, presenting a video of Bard's March 2022 police statement. Bard, arrested in northern New Brunswick, confirmed he knew the individuals mentioned and stated, 'let's go to court,' advising he had been told by lawyers not to speak. He expressed confidence in his justification for all dealings, stating, 'It's time that it happens.'
