Court Overturns Constable Rejection Over Winged Scapula
27 Aug
Summary
- Calcutta High Court ruled rejecting candidates solely on clinical findings illegal.
- Medical exams must include confirmatory tests and specialist opinions.
- A constable candidate was wrongly rejected for a winged scapula condition.

In a significant ruling on August 4, 2026, the Calcutta High Court declared that rejecting candidates for constable posts in the Central Armed Police Forces (CAPF) based solely on clinical findings is unlawful. The court addressed the case of a candidate who was deemed unfit for a constable (general duty-GD) position due to a winged scapula condition.
The bench highlighted that RME guidelines mandate that decisions on rejection must be supported by valid clinical findings, corroborated by investigation reports, and, if necessary, specialist opinions. The court found that the RME board had failed to adhere to these mandatory protocols when declaring the petitioner medically unfit.
Consequently, the court set aside the RME's December 2025 order and mandated a fresh medical examination for the candidate within eight weeks. This new examination must strictly follow the prescribed guidelines, ensuring thorough investigation and the inclusion of confirmatory tests and expert opinions where appropriate.
