Bombay HC Appoints Amicus in Age Limit ART Case

The Bombay High Court is reviewing pleas from two women, aged 53 and 55, who are challenging the upper age limit of 50 for women receiving donated sperm under the Assisted Reproductive Technology (ART) Act of 2021. The petitioners presented medical certificates asserting their fitness to carry a pregnancy to term and deliver a child.
However, the division bench expressed a need for scientific research to validate the medical feasibility and safety of pregnancy for women at such advanced ages. Without supporting data, the court deemed it necessary to appoint an amicus curiae to assist in analyzing the complexities of the case. Senior advocate Ashutosh Kumbhakoni has been appointed to this role, and the petitioners' counsel will provide further research within three weeks. The court is set to hear the matter again on April 22.
