The Bombay High Court recently denied relief to two individuals accused in a significant digital fraud case. The court determined that the grounds of arrest were adequately communicated when explained in Hindi, despite written notices being in Marathi.
Investigators allege the accused, involved in a Rs 58 crore digital arrest fraud, used 6,000 accounts to obscure the money trail. They are suspected of similar crimes totaling nearly Rs 500 crore from multiple victims. The court noted that one accused resided in Thane and could not claim ignorance of Marathi.
The bench questioned the focus on accused rights over victims' substantial losses, stating, "Judgment after judgment, we are only talking about the rights of the accused, isn't it? What about the rights of the victim who is duped of how many crores? Only Rs 58 crore."
