Bombay High Court Bars Man from Diwali Celebrations with Second Family

In a recent decision, the Bombay High Court has restricted a man from celebrating Diwali in his Mumbai flat with his second wife and their children. The court has only permitted the man and his mother to stay in the flat during the Diwali festivities.

The court's decision comes after the man's ex-wife objected to him bringing his new family to the flat, claiming their presence would be distressing for her. The couple had married in March 1999 and have a daughter together, but their marriage was dissolved in August 2022 on grounds of cruelty.

Following the divorce, the man remarried and now resides in Thailand with his wife and two minor children. In April 2024, the man faced issues when his ex-wife did not allow him to stay in the flat. The court has now deemed it fit to allow only the man and his mother to stay in the flat during the Diwali vacation, citing the potential for further disharmony between the parties.

The judges have clarified that this arrangement is only temporary, as the man's appeals against the family court's order are still pending. The court has expressed concern over the emotional impact this situation might have on the ex-wife.
