A tragic accident in March 2016 left a kho-kho and long jump champion with a 66 percent permanent disability, shattering her sporting and educational dreams. Over ten years later, the Delhi High Court has ordered an insurer to deposit Rs 10 lakh for her future surgical needs. This ruling came as the court refused to reduce the Rs 6 lakh compensation previously awarded for her lost educational opportunities and marriage prospects.
The incident occurred on March 12, 2016, when the bus Kaur was traveling on was struck by a truck. Her injuries included a deformed left foot, amputated toes, and a shortened limb. The court recognized that the ability to pursue academics, sports, career, and family are ordinary life expectations that should be compensated if taken away by an accident.
Regarding future treatment, the court mandated Rs 10 lakh for specialized surgery estimated at Rs 9.35 lakh, acknowledging the complexity and extended recovery time. The insurer had challenged the Rs 4 lakh for lost studies and Rs 2 lakh for lost marriage prospects. However, the high court upheld these amounts, viewing them as integral to loss of amenities of life.
