Summary

- Customer claims she was diagnosed with oral herpes afterward.
- Lawsuit filed against employee and Arby's restaurant.

An Oklahoma woman is suing Arby's, claiming an employee spit in her food and transmitted oral herpes. The alleged incident occurred on March 28 at a Broken Bow Arby's location.
The plaintiff, Jennica Church, ordered four sandwiches. Surveillance footage reportedly shows employee Amanda Hendricks spitting into one of the sandwiches before completing the order. Church claims she consumed the contaminated food and later developed painful lesions diagnosed as oral herpes.
Church's lawsuit asserts Hendricks knew she had the herpes simplex virus type 1 (HSV-1) at the time. The suit alleges the condition has caused significant emotional distress and fear of transmitting the virus.
Hendricks was arrested on June 21 and faces felony poisoning charges. Her next court date is July 21. Arby's has not yet commented on the lawsuit.
