Andhra HC: External Cases Can Fuel Detention
26 Sep
Summary
- Offenses outside jurisdiction can support detention if impact is explained.
- Detention order failed to link external cases to local public order.
- Court also noted failure to consider bail conditions for detention.
The Andhra Pradesh High Court has clarified the criteria for preventive detention, stating that offenses outside a detaining authority's territorial jurisdiction can be considered. Crucially, the detention order must explicitly detail how such external offenses negatively impacted public order within the authority's purview.
The high court subsequently overturned the preventive detention of D Jayaprakash, alias Jaya. The Nellore collector's detention order, issued on December 2, 2025, was based on three criminal cases. Two of these cases were registered outside the collector's jurisdiction, while one was within it.
The court found that the Nellore collector's order failed to establish a clear link between the two cases registered outside his jurisdiction and any adverse effect on public order within Nellore. Furthermore, the bench noted that the detention order did not consider the bail conditions granted to Jaya in two of the cases, which are relevant for assessing the necessity of continued detention. The high court emphasized that the state cannot retroactively cure such defects with subsequent affidavits.
