Judge Lin noted the absence of allegations directly implicating OpenAI's conduct. xAI did not provide facts showing OpenAI encouraged employees to steal trade secrets or that such secrets were used after employment. The company can refile the case but must strengthen its claims.
This legal action is one component of an ongoing broader legal conflict involving Musk and OpenAI, an organization he co-founded. Musk is also pursuing separate litigation against OpenAI concerning its transition to a for-profit business model.
